Still Another Impartial Voice Says to "Take the Handcuffs Off
WASHINGTON - s4story -- In what may be the most lopsided and overwhelming vote on his Saturday morning CNN program, viewers of Michael Smerconish voted 87%-13% for the Senate tor grant Dr. Anthony Fauci immunity so that the public can finally get "answers about COVID's origins and gain-of-function research, not a perp walk.
Smerconish thus joins a growing list of impartial experts who have all concluded that other proposed alternatives - such as holding the doctor in contempt of Congress - are likely to fail, and in any event would not provide any information before the coming elections.
As Smerconish, who is also a lawyer, noted:
"There's a simpler path [than contempt], and so far it's been hiding in the fine print of the legal explainers: the Senate can grant 'use immunity' and compel testimony. Jonathan Turley acknowledged the option. So did national security attorney Bradley Moss, who then added a cynical kicker: 'I doubt they will do so, because these hearings aren't about getting facts.' Prove him wrong. Grant Dr. Fauci immunity and invite him back. Immunity takes the handcuffs off the table and removes his stated reason for silence. And it's no license to lie — false testimony under a grant of immunity is a fresh crime. If Senator Paul truly wants answers about COVID's origins and gain-of-function research, not a perp walk, that's the trade. And if Fauci truly has nothing to hide, he takes it."

In addition to attorney Bradley Moss and law professor Jonathan Turley mentioned by Smerconish, noted law professors Alan Dershowitz and John Banzhaf, as well as federal prosecutor Neama Rahmani, have all concluded that the public interest would best be served by forcing Fauci to testify by granting him immunity; a time-tested tactic which has worked in the past, and does not present the glaring legal problems using contempt or criminal referrals would clearly have, argued Banzhaf.
Republicans would lose the opportunity to criticize Fauci for "hiding behind the Firth," and Democrats may find some of their defenses of the doctor undercut if he is forced to testify, but the members of the public would clearly be the beneficiaries.
We would all learn more about how COVID was and should be handled; knowledge which could save many lives if there is ever another similar epidemic, says Banzhaf.
