WHAT IMPORTERS NEED TO KNOW:
The refund window covers all IEEPA tariffs paid between February 4, 2025 (when the first fentanyl-related tariffs took effect) and February 24, 2026 (when the Supreme Court's ruling ended IEEPA authority). Affected tariff rates include:
- China: ~10–25% IEEPA duties
- Canada and Mexico: 25% IEEPA duties
- All other countries: 10% reciprocal tariff
IMPORTANT: The Department of Justice is expected to appeal the CIT's March 4 order. Trade attorneys recommend that importers file a protective action in the Court of International Trade to preserve their rights while the appeal process unfolds.
