Aging Breath Testing Technology Faces Increased Legal Scrutiny
NEW YORK - s4story -- More than 4,000 people were arrested for Driving While Intoxicated (DWI) in New York City during 2025. In many of those cases, prosecutors relied on breath alcohol evidence generated by the Intoxilyzer, a machine whose core technology has not changed since the 1970s.
Breath test evidence often becomes one of the most important pieces of evidence introduced in a DWI prosecution. A reported blood alcohol concentration above the legal limit can significantly strengthen the prosecution's case.
