Phoenix Metro Families Face a Narrower Path in Probate and Senior Care Transitions, Brokers Say

S For Story/10704171
Arizona's small estate affidavit thresholds, 2026 ALTCS limits, and a cooling market mean selling a family home now carries more weight than a standard listing, whether the trigger is a death in the family or a parent moving into care.

PHOENIX - s4story -- PHOENIX — National Network Realty, a licensed Phoenix-metro brokerage led by Brad and Sher Kelley, works with families across Maricopa and Pinal counties who are often making real estate decisions before they understand the rules that apply to them. For families settling an estate, Arizona's small estate affidavit thresholds sit at $200,000 for personal property, with a 30-day wait, and $300,000 assessed value for real property, with a six-month wait, under HB 2116.

For families moving a parent into assisted living or memory care, the 2026 ALTCS limits allow a single applicant $2,982 in monthly income and $2,000 in countable assets, with home equity exempt up to $752,000. A community spouse may generally keep between $32,532 and $162,660 under the community spouse resource allowance, and a five-year lookback period on transfers means gifting or signing away a home too early can delay or disqualify eligibility. In both scenarios, the property decision generally needs to be settled early, since where a home falls relative to these numbers can change a family's entire timeline.

"We triage real estate by removing the obstacles standing between people and their next chapter," said Brad Kelley, broker and co-owner of National Network Realty.

Brad and Sher opened their first brokerage together in 2008 and have a combined 63 years in Arizona real estate. Rather than steering every conversation toward a single option, we walk families through the full range of paths for a home, including a traditional listing, a seller carry-back, a wraparound mortgage, a rental, a cash sale, or exploring a reverse mortgage, whether obtaining a new one or unwinding an existing one, connecting them with attorneys, lenders, financial planners, or care advisors as needed. We're the real estate piece of a larger plan, not the whole plan.

Metro Phoenix pending home sales fell 34.8 percent year-over-year in August, the lowest total since 2009, and days on market stretched to 78, up from 73 a year ago. In a cooling market, a properly priced listing may net more for a family than a fast cash sale.

We operate under an Arizona real estate entity license and act as a fiduciary to our clients.
