Supreme Court Upholds Birthright Citizenship, Blocking Trump Executive Order
S For Story/10696470
TEMPLE TERRACE, Fla. - s4story -- The U.S. Supreme Court ruled 6-3 today to uphold birthright citizenship under the 14th Amendment, striking down President Trump's executive order that sought to deny automatic citizenship to children born in the United States to parents who are unlawfully or temporarily present in the country. The decision in *Trump v. Barbara* was authored by Chief Justice John Roberts, who wrote that the Framers of the 14th Amendment "extended that promise to 'every free-born person in this land' — we keep that promise today."
The ruling affirms more than a century of precedent rooted in the court's 1898 *United States v. Wong Kim Ark* decision and delivers a significant constitutional victory for millions of immigrant families nationwide — including the estimated hundreds of thousands living in Florida.
Ahmad Yakzan, an immigration attorney and founder of American Dream Law Office PLLC in Tampa, is urging immigrant families not to let today's relief overshadow the full picture of the current legal landscape.

"This is an important and welcome ruling, but it does not erase the very real legal dangers immigrant families face right now," said Ahmad Yakzan, immigration attorney and founder of American Dream Law Office PLLC. "A U.S.-born child keeps their citizenship — that is settled today. But their parents remain subject to removal, and Florida is ground zero for enforcement. We've seen over 10,000 arrests under Operation Tidal Wave, and the Supreme Court just last week upheld the government's authority to turn away asylum seekers at the border. Families need a legal strategy, not just reassurance."
The timing of the ruling is striking. It comes days after the court's June 25 decision allowing federal agents to turn back asylum seekers before they physically enter the United States — a ruling immigration advocates called a catastrophic blow to the right to seek refuge. Simultaneously, a new USCIS policy memo is requiring most immigrants on temporary visas to leave the country and pursue green cards through consular processing abroad, dramatically limiting in-country adjustment of status.

Yakzan notes that parents of U.S.-citizen children can still face deportation, and that the USCIS memo may cut off green card pathways that were previously available inside the country. "Today's ruling protects the child's status. It does not protect the family unit unless the parents also have lawful status or a viable path to it. That distinction matters enormously."
Immigrant families in Florida with questions about how these developments affect their specific situations are encouraged to seek qualified legal counsel as soon as possible. To schedule a consultation, call (813) 335-4938 or visit https://americandreamlawoffice.com.
